THE KUBOTA APPROACH TO PROTECTING CONSUMER PRIVACY

Kubota Credit Corporation, USA ("KCC") and Kubota Tractor Acceptance Corporation ("KTAC"), here and after referred to collectively as "Kubota," take consumer privacy seriously as a direct result of mandates levied by regulatory and statutory directives. Furthermore, Kubota, as a matter of business ethics, understands that transparency and respect are foundational aspects of establishing and maintaining longstanding relationships with customers. Therefore, Kubota shall take every reasonable effort to protect personal information (as it presents itself in many forms) provided by customers over the course of standard business transactions.

This policy outlines how Kubota collects, uses, protects, and discloses so-called "consumer personal information," both "intra" and "post" the conduct of business cycles with individual consumers. A massive volume of data is exchanged through the process of "doing business." This document (both a "Policy" and "Terms of Use" statement) details policies and practices related to all modes of handling consumer personal information with "privacy" and "consumer protection" principles and directives providing requisite focus. The document shall be made available to consumers and auditing authorities "on demand" who are interested in gaining insight into Kubota data handling and privacy protection practices, specific especially to ongoing dispensation and accessibility of consumer personal information collected via various Kubota website portals.

Kubota products are distributed through a network of independently owned and operated dealerships, some of which may have developed additional privacy policies based on location and jurisdiction.

INFORMATION COLLECTION AND USE

Information Categories and Purposes for Collecting It

Kubota collects numerous categories and classifications of consumer information for various purposes in order to provide "best-in-class" products and customer-service.

Kubota websites collect three general categories of information: "Personal Information," "Anonymous Information," and "Product or Inquiry Information." Kubota may also collect Personal Information offline in the Credit and Insurance application processes. Kubota collects customer information in order to provide the services outlined in this Policy or to provide best-in-class customer service.

Personal Information

Depending on the functionality customers access on various Kubota websites, the following categories of personal information may be collected and applied in business or transactional processes detailed hereunder:

  • Personal Data - Kubota may ask customers to provide us with certain personally identifiable information ("PII") that can be used to contact or identify individuals (a class of data also sometimes referred to as "Protected Personal Data.") Personal Data may include (but is not limited to) the following: Email address, First name and last name, Phone number, Address, City, State, Province, ZIP/Postal code, City, and a given PC Internet Protocol ("IP") address.
  • Usage Data - Kubota may also collect information about how web-based Services are accessed and utilized by consumers ("Usage Data") which may include information such as a consumer's IP address, browser type, browser version, the pages of Kubota Services visited by individual consumers, the time and date of these visits, the time spent on those pages, unique device identifiers, and other diagnostic data.
  • Physical Location and Contact Information - This information allows Kubota to identify and communicate with individual consumers, and includes information such as "name, mailing address, email address, and phone number."
  • Relationship Information - Allows us to offer beneficial products and services to targeted consumers, such as information regarding inquiries, purchases, regional location, and dealer transactions.
  • Financial Account Information - This information is necessary to complete consumer purchases, such as credit card information and information about equipment financing and leasing activities.
  • Financing Information - Consumers applying for financing through KCC are required to provide PII which includes data such a first and last name, date of birth, Social Security number, mailing address, email address, home phone numbers and cell phone number, as well as certain employment and income information. KCC also collects credit information from credit reporting agencies to facilitate and finalize the financing transaction and as part of an ongoing relationship with consumers who in effect become Kubota "customers."

Anonymous Information

By using Kubota websites and online services, consumers agree to the collection of certain information that Kubota uses to improve websites' functionality. This information is not tied to individuals personally, but is used "in aggregate" to better understand demographics of website visitors (such as age, language and gender), what web pages visitors are most often browsing to, the amount of time spent on each page, the device type used to visit the given website, and other technically and commercially relevant information.

Product or Inquiry Information

Kubota uses inquiry forms throughout its websites to allow consumers to request information, including product, service, or dealer quote information. Any personal information collected in these forms is used to either fulfill requests or to better understand details tied to individual requests. Kubota does not collect sensitive personal information such as Social Security numbers or financial information in collection and execution of these inquiry forms.

CATEGORIES OF SOURCES OF PERSONAL INFORMATION

Kubota collects consumer information from various sources:

Directly from "The Consumer"

  • General "Contact Us" forms
  • Finance applications
  • Product and service inquiry forms
  • Dealer Locator, Dealer Contact Request, and "Build My Kubota" finance pages
  • Social media accounts
  • Contests or sweepstakes

From "The Consumer" through third parties

  • Ceridian (Kubota career job portal): Kubota uses Ceridian to support an employee application portal, "Kubota Careers." Kubota Human Resources has access to all information submitted via Ceridian, but only uses such information for recruitment and interviewing processes. Please note the presentation of a "cookie banner" on this site which requests users' acceptance of clearly defined Terms of Use.
  • Fontis (Operator Manual purchase): Consumers can purchase Kubota operator manuals through a partner vendor, "Fontis," via the Kubota website. Other than the fact that a consumer has purchased Kubota manuals through Fontis, Kubota does not have access to any other sensitive information relating to these purchases, such as personal or credit card information.

Information Collected from Business Partners and Affiliates

Kubota may collect information from certain business partners that support specific types of transactions or have a relationship with certain consumers. This includes, but is not limited to, the following: dealers, Kubota affiliates, or third party financial service companies involved with applications for credit.

Information Collected through Use of Kubota Websites; and, "How Kubota Responds to "Do Not Track" Signals (cookies)"

Consumers logging on to Kubota websites for the first time are presented with a notice regarding Kubota policy regarding use of cookies to automatically track certain information. Kubota does not collect any information until a consumer has accepted this cookie policy. Consumers may still use Kubota websites after declining this cookie policy, and tracking information will not be collected or tracked. However, consumers will not enjoy the benefits arising from use of cookies, such as recognition of repeat users or provision of advertisements related to specific products that may be of interest to individual customers.

Consumers accepting the Kubota cookie policy consent to the collection of information tied to online activities via certain online tracking mechanisms deployed on various Kubota websites. These collect information regarding individual browsing activities, including the following:

  • IP address
  • Device type
  • Operating system
  • Browser language
  • Web pages visited, time on the website, and total number of pages viewed
  • Network service provider

If consumers accept the Kubota cookie policy, third party ad network providers will be deployed to help present targeted advertising. These providers place and access cookies, pixel tags, or similar technologies on individual devices to serve ads or other content personalized to identified interests, which they infer from location and/or browsing data on the platform and other sites individuals are known to have visited. In this manner, the provider is authorized to access and collect information such as individual browsing history.

Kubota maintains a full and up-to-date list of online tracking technologies deployed on various websites so consumers can better understand what information is being collected during visits to company websites. Some browsers have a "do not track" feature that allows consumers to directly disallow websites from tracking online activities tracked. These features are not yet uniform, and so Kubota is not currently configured and enabled to respond to such aggregated signals. However, consumers declining the Kubota cookie policy upon first log-on to any company websites will not be tracked in any way, form, or manner.

Social Media, Surveys and Contests

Kubota uses social media to interact with current customers and general consumers in various ways. Kubota may use anonymized aggregate information gathered through interaction with social media accounts or through surveys and contests, using this information to improve products, services, and marketing effectiveness. Kubota may offer products and services to individuals via social media, based on information individuals have voluntarily provided (or "opted-in to provide") in accordance with the social media site's Terms and Conditions ("T and C").

DATA DISCLOSURE

Legal Requirements

Kubota may disclose consumers' Personal Data in the "good-faith belief" that such action is necessary in the midst of the following scenarios:

  • To comply with federal or state law, a court order, or other legal or regulatory process;
  • To protect and defend the rights or property of Kubota;
  • To prevent or investigate possible wrongdoing in connection with a given Kubota-sponsored Service;
  • To protect the personal safety of users of the Service or the public;
  • To protect against legal liability;
  • In connection with the sale of or change of management of Kubota.

Third Party Use and Disclosure

Kubota understands consumer concern over the non-authorized sharing of personal information with other parties. For this reason, Kubota does not share any consumer information except as described in this policy and authorized directly by individual consumers. When authorization occurs, Kubota may share information with the following types of entities:

  • Business partners, dealers, and service providers to provide products and services relating to the sale of Kubota products, internal company processes, or the servicing of accounts or transactions;
  • Marketing partners, to market to consumers directly;
  • Auditors, regulators and other entities, when required by regulatory or statute;
  • As needed to protect Kubota rights and property;
  • Kubota affiliated companies (i.e., companies under common control or management).
Kubota does not share personal information with other unaffiliated third parties for their own direct marketing purposes. Kubota endeavors to screen and attest that all vendors are able to protect consumer information while "at rest" and "in transit," both online and offline, and are limited to using said consumer information only in accordance with published and compliant purposes.

Employment Opportunities

Information collected through the Kubota Careers portal is used in the Company's recruitment process. It is only shared with Kubota Human Resources and specific management that have a "need to know:" that is, to view the collected information as it relates to a posted employment opportunity.

Google Analytics

Google Analytics is a web analytics service that tracks and reports website traffic. Google uses the data collected to track and monitor the use of various Kubota Online Services. This data is shared with other Google services. Google, by stated policy, may use the collected data to contextualize and personalize the ads of its own advertising network.

Consumers can opt-out of having individual online activity made available to the Google Analytics Service by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits and other such online activity.

Kubota may use third-party integration into Company websites to better serve consumers' needs. Kubota affords ready access to the following privacy policies (developed by other Company entities) to individuals seeking deeper understanding of general data collection, use, and disclosure, especially as these relate to secure handling of sensitive information:

CONSUMER REQUESTS TO "REVIEW AND REQUEST CHANGES TO PERSONAL INFORMATION" - RIGHT TO "EQUAL SERVICE AND PRICE"

Where allowed by state and federal law, California consumers may exercise so-called "data access and data review" rights up to two times per year at no charge, requesting Kubota facilitate California consumer requests in connection with the following:

  • Disclose the categories of a consumer's personal information that Kubota has collected during the immediately preceding calendar year, the categories of sources from which the personal information was collected, and the purpose of collecting said personal information;
  • Disclose the names of third parties with whom Kubota shared a consumer's personal information;
  • Disclose the categories of personal information disclosed for third-party use during the immediately preceding calendar year, along with the names of these third parties;
  • Deletion of a consumer's personal information from Kubota systems;
  • Update of a consumer's personal information in Kubota systems;
  • "Stop sharing/disclosing" a consumer's personal information;
  • Opt-out of receiving marketing material.
  • Documentation/verification.
This can be accomplished by using the "Exercise Your Rights" option on the www.kubotacreditusa.com and www.ktacinsuranceagency.com websites (submitting an email to kubotaprivacy@kubota-na.com) or by sending a written request to ATTN: Kubota Privacy 1000 Kubota Drive, Grapevine, TX 76051.

Consumers who financed a purchase of equipment through KCC should call 888-465-8268 to exercise "right to opt-out". Consumers opting-out of receiving marketing material should still remain accessible to Kubota in order to receive important account or equipment information. (For example, product safety communications.) To protect consumer privacy, Kubota will require consumers to provide authenticating information, which includes information specifically relevant to individual accounts prior to making changes or gaining access to specific information. By policy, Kubota will respond to inquiries, "requests to review," and "change requests to personal information" within 45 days of original receipt.

Consumer exercise of any of these rights will not alter how individuals are treated by Kubota. Kubota will not offer any financial incentive for the collection, sale, or deletion of personal information. EU residents have the legal right to request access to, and rectification or deletion of, any data provided to Kubota. EU residents also have the right to seek a restriction of Kubota processing of the data, to object to Company processing of the data, or to transfer the data to another company. Note, however, that certain information is required for Kubota to process such orders and restricting or deleting access to data may make it impossible for provision of the requested services. Should consumers believe that Kubota processing of personal information is non-compliant, he/she has the right to lodge a formal complaint with any given regulatory authority.

Kubota may still contact consumers to request information needed to service individual accounts or pieces of equipment, or to support ongoing transactions related to individual accounts.

If the consumer designates an authorized agent to make a request, Kubota will require the authorized agent to provide a power of an attorney or a notarized authorization to validate the authorization.

SECURITY OF DATA

Providing sound stewardship in working to ensure the security of customer data is important to the people who work for Kubota in many capacities. Kubota periodically assess risks to consumer information and updates associated policies, procedures and technology accordingly. Unfortunately no method of transmission of data over the Internet, or method of electronic storage, is 100% secure. Although Kubota strives to implement and utilize strong technical and organizational measures to help ensure a level of security appropriate to the risks represented by the processing and the nature of the Personal Data to be protected, "absolute security" cannot be guaranteed.

CHILDREN'S PRIVACY

Kubota does not knowingly collect PII from or market directly to children under the age of 16 years old. If a child under the age of 16 has provided PII to Kubota through a Company website, a parent or guardian may contact kubotaprivacy@kubota-kna.com and request that the information be summarily deleted. Following receipt of such a request, Kubota will make reasonable efforts to delete the child's information as expediently as possible.
